General terms and conditions

  1. Subject Matter of Contract Sven Lindstädt Segeltechnik (hereinafter referred to as "Operator") sells the goods specified in print catalogs, flyers, and online stores to the customer (hereinafter referred to as "Customer") under the delivery and sales conditions (AGB) listed below.

  2. Conclusion of Contract The contract between the customer and the operator is concluded only through an order from the customer and its acceptance by the operator. The customer's order is placed by telephone, in writing, or online. The operator accepts the order by sending the customer an order confirmation (by fax, e-mail, or postal mail) or by delivering the ordered goods (including delivery note).

  3. Product Offer All information about the goods that the customer receives during the ordering process is not binding. In particular, changes that improve the functionality of a product, as well as errors in description, illustration, and price information, are subject to change. All information about the individual goods is based on the information provided by the manufacturers and is binding within this framework.

  4. Payment Terms All catalog prices are target prices that are continuously adjusted to the market. They are in euros (€), including VAT. Transport and packaging costs are charged separately. Payment must be made net within 7 days of invoice. New customers can only make purchases with prepayment, cash on delivery, or cash payment. The operator reserves the right to supply even existing customers only by means of these payment options.

  5. Delivery Conditions If the products are in stock, they will be delivered immediately to the address specified by the customer. Otherwise, a written order confirmation will be sent with the expected delivery date. The goods are delivered (from Norderstedt warehouse) at the customer's expense and risk, even if partial deliveries are made. Compensation for damages will only be made against a certificate from the respective freight forwarder for visibly damaged ordered goods.

  6. Retention of Title The delivered goods remain the property of the operator until full payment has been made. If the customer is in default with payment of the purchase price, the operator is entitled to withdraw from the contract (declaration of withdrawal) and take possession of the goods.

  7. Right of Withdrawal The customer has a 14-day right of withdrawal. The delivered goods must be returned undamaged, functional, complete, and in the original packaging or sealed condition. Used, defective, and damaged items will not be accepted for return or refunded. Products that were made to order for the customer or specially ordered for the customer, and items with opened sealing are not returnable. Incomplete items (missing components and packaging, etc.) will also not be accepted.

  8. Warranty and Liability For all new products offered, the warranty period is 24 months, and for used products, the warranty period is 12 months from the date of purchase, unless another warranty period is expressly stated. The warranty expires if changes or repairs are made to the goods without the operator's written consent. To the extent permitted by law, liability for damages is excluded. In particular, the operator is not liable for damages resulting from improper use or natural wear and tear, or for damages that did not arise on the delivery item itself (consequential damages).

  9. Jurisdiction and Applicable Law The place of jurisdiction is the operator's registered office. The legal relationship is governed by German law.

  10. Final Provisions: The terms and conditions in force at the time of concluding the respective contract exclusively apply to the sale of goods specified in print catalogs, flyers, and the operator's web store. These terms and conditions apply in particular even if they differ from those of the customer. In addition, for the delivery of software, the license terms of the manufacturer included and/or contained on the data carrier also apply. By opening the sealed data carrier, the customer expressly acknowledges the applicability of these terms and conditions. If individual provisions of these terms and conditions are or become invalid, the legal effectiveness of the remaining provisions is not affected.
